Terms of Service

Effective date: March 24, 2026

These Terms of Service ("Terms") govern your use of the Daisy app ("the App"), operated by PMP Labs, Inc. ("we", "us", "our"). By using Daisy, you agree to these Terms.

1. What Daisy Is

Daisy is an AI companion app that provides friendly, conversational interactions with AI-generated characters. Daisy is designed for social companionship and entertainment. Daisy is not a substitute for professional medical, mental health, legal, or financial advice.

2. Eligibility

You must be at least 18 years old to use Daisy. By creating an account, you confirm that you meet this age requirement.

3. Your Account

You are responsible for maintaining the security of your account credentials. You may sign in with Apple or with an email and password. You may delete your account at any time from the Profile tab, which permanently removes all your data.

4. AI Companions

All companions in Daisy are AI-generated fictional characters. They are not real people. Their responses are generated by artificial intelligence and may not always be accurate, complete, or appropriate. Specifically:

• Companions cannot provide medical, mental health, legal, or financial advice
• Companions may occasionally produce inaccurate or inconsistent responses
• Companions cannot take actions outside the app (make calls, send emails, browse the internet, etc.)
• Companion "memories" are AI-generated summaries and may not perfectly reflect your actual conversations

5. Crisis Resources

If you express thoughts of self-harm or crisis during a conversation, the app will display crisis resource information including the 988 Suicide and Crisis Lifeline. This is an automated response, not a professional intervention. If you are in immediate danger, please call 911 or your local emergency services.

6. Subscriptions and Payment

Daisy offers a free trial period, after which a paid subscription is required for continued access. Subscriptions are managed entirely through Apple and the App Store:

• Monthly: $9.99/month
• Annual: $79.99/year
• Free trial: 5 days of full access

Payment is charged to your Apple ID account. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription in your Apple ID settings.

We do not offer refunds directly — refund requests should be directed to Apple through their standard process.

Your use of the App is also subject to Apple's Licensed Application End User License Agreement.

7. Acceptable Use

You agree not to:

• Use the app to generate harmful, abusive, or illegal content
• Attempt to manipulate AI companions into providing professional advice they are not qualified to give
• Use automated scripts or bots to interact with the service
• Attempt to access other users' data or compromise the security of the service
• Resell, redistribute, or commercially exploit the service

8. Intellectual Property

The Daisy app, its companion characters, visual assets, and underlying technology are the property of PMP Labs, Inc. Your conversations belong to you, but you grant us a license to process and store them as described in our Privacy Policy to provide the service.

9. Limitation of Liability

Daisy is provided "as is" without warranties of any kind. To the maximum extent permitted by law:

• We are not liable for any actions you take based on AI companion responses
• We are not liable for emotional distress arising from use of the service
• We are not liable for service interruptions, data loss, or technical failures
• Our total liability is limited to the amount you paid for the service in the 12 months prior to the claim

10. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the app or by email. Continued use of Daisy after changes take effect constitutes acceptance of the updated Terms.

11. Termination

We may suspend or terminate your account if you violate these Terms. You may stop using Daisy and delete your account at any time. Upon termination, your right to use the service ceases and your data will be deleted.

12. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of Daisy will be resolved in the state or federal courts located in New York.
